TERMS & CONDITIONS

By booking or participating in a Pedal The Port tour, you acknowledge that you have read, understood and agree to the following Terms, Conditions and Release of Liability.
These terms apply to all participants of Pedal The Port tours.

1. Definitions

For the purposes of these Terms and Conditions:
Pedal The Port / We / Us / Our refers to the operator of Pedal The Port tours based in Echuca, Victoria.
Participant / Rider / You refers to any person participating in a Pedal The Port tour.
Tour refers to the guided pedal-powered group bike experience operated by Pedal The Port.
Tour Operator / Guide refers to the Pedal The Port staff member responsible for operating, steering and supervising the vehicle during the tour.
Vehicle refers to the multi-passenger pedal-powered bike used during the tour.
Tour Date refers to the date and time a booking is scheduled.
Licensed Venue refers to pubs, bars or venues visited during the tour that hold a valid liquor licence.

2. Participation Requirements

Participants must meet the following requirements:
• Participants must be 18 years of age or older to participate in Pedal The Port tours that include licensed venue stops.
• Participants must follow all instructions given by the Tour Operator.
• Participants must behave in a safe and respectful manner at all times.
• Participants must not engage in unsafe, reckless or illegal behaviour during the tour.
Pedal The Port reserves the right to refuse participation or remove any person from the tour if their behaviour is unsafe or inappropriate.
No refunds will be provided in these circumstances.

Helmets are not required for passengers, however helmets may be available upon request.
Helmets must be worn by the Tour Captain / Driver if applicable.
If a participant chooses not to wear a helmet they acknowledge and accept the risks associated with cycling activities.
By choosing not to wear a helmet you agree that:
• You participate at your own risk
• You release Pedal The Port and its operators from liability related to this choice

Alcohol consumption is strictly prohibited on the Pedal The Port vehicle.
Participants must not bring alcohol onto the vehicle.
Pedal The Port reserves the right to refuse service to anyone who is intoxicated or behaving in a disruptive or unsafe manner.
Any participant who arrives intoxicated will be refused participation without refund.

Participants confirm that they are physically capable of participating in the tour.
Participants must not participate if they:
• Have a medical condition that may make cycling unsafe
• Are under the influence of drugs
• Are unable to follow safety instructions
Participants agree to inform the Tour Operator of any relevant medical conditions before the tour begins.
Participation is voluntary and at your own risk.

Participants agree to follow all safety instructions provided by Pedal The Port staff.
This includes but is not limited to:
• Remaining seated while the vehicle is moving
• Keeping hands and feet inside the vehicle
• Following directions given by the Tour Operator
• Respecting road and pedestrian safety rules
Failure to follow safety instructions may result in removal from the tour.

7. Risk
Acknowledge-ment

Participants acknowledge that Pedal The Port tours involve inherent risks including but not limited to:
• Cycling activities
• Movement of the vehicle
• Road and traffic environments
• Weather conditions
• Interaction with public spaces
These risks may result in injury, illness, damage to property or in rare cases serious harm.
By participating in a Pedal The Port tour you voluntarily accept and assume all risks associated with the activity.

To the maximum extent permitted by law, participants release Pedal The Port, its owners, employees, guides and representatives from any liability for injury, illness, loss, damage or expense arising from participation in the tour.
This includes but is not limited to:
• personal injury
• property damage
• accidents or incidents during the tour
• negligence of other participants

Participants agree to indemnify and hold harmless Pedal The Port, its employees, contractors and representatives against any claims, losses, damages or legal expenses arising from their participation in the tour or breach of these Terms and Conditions.

Pedal The Port operates tours in most weather conditions.
In the event of extreme weather or unsafe conditions, Pedal The Port may:
• reschedule the tour
• provide a credit
• provide a refund if rescheduling is not possible
The safety of participants and staff is the priority.

11. Booking & Cancellation Policy

Cancellation terms apply to all bookings.
• More than 72 hours before the tour: Free cancellation
• 24 – 72 hours before the tour: 50% cancellation fee
• Less than 24 hours before the tour or no-show: 100% cancellation fee
Pedal The Port may charge cancellation or no-show fees in accordance with this policy.

12.Photography & Media

During tours, photos and videos may be taken for promotional purposes.
By participating in the tour you consent to Pedal The Port using images or videos taken during the tour for marketing, social media and promotional material.
If you do not wish to appear in media, please notify the Tour Operator before the tour begins.

13. Personal Property

Participants are responsible for their own personal belongings.
Pedal The Port is not responsible for loss, theft or damage to personal items brought onto the tour.

14. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia.
Any disputes arising from participation in Pedal The Port tours will be subject to the jurisdiction of the courts of Victoria.
